Statutory Authority: This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13—Simplified Acquisition Procedures and at a dollar value less than the simplified acquisition threshold are exempt from the requirements of FAR Part 6—Competition Requirements.

This notice of proposed acquisition is posted as an intent to award a service contract on a non-competitive basis to BD Biosciences, 2350 Qume Drive, San Jose, CA 95131.
Background/Description of Requirement

The NIA Flow Cytometry Unit, NIA IRP functions as a Shared Resource Laboratory “core” to provide analytical flow cytometry and cell sorting services to NIA IRP investigators and to provide the scientific and technological support to make possible these complex experiments. Flow cytometry is an integral part of evolving biomedical research, driving some of its major advances. The ability to separate heterogeneous populations by flow cytometry is the basic dynamic making possible advances in systems biology, especially the development and application of single-cell transcriptome analysis, molecular profiling, and the integration between cytomics and proteomics. The ability to provide cutting edge flow cytometry in terms of multi-parameter (polychromatic) analysis and sorting is entirely dependent upon technological innovations in the field and our ability to secure these resources. To accommodate the needs of current users and serve as a long-term investment in the flow core, we require service contracts and repairs on these complex instruments. BD Biosciences is the only entity to provide comprehensive service and support for instruments by factory-trained technical service representatives. These statements are supported by a Sole Source letter.

Acquisition Authority:  This acquisition is being conducted under Federal Acquisition Regulations (FAR) Part 13 – Simplified Acquisition Procedures, and the resultant contract award will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2022-04 dated January 30, 2022.

Description: The contractor shall provide repair service of the NIA Flow Cytometry Unit BD FACSAria Fusion Special Order System. The repair service is to include parts, labor and travel. A site visit to diagnose the repairs and subsequent visits as required to remedy the equipment. The Government shall provide the contractor with access to the instrumentation and workspace for repair support. The contractor field service technician servicing the equipment will be required to coordinate with the program office in advance of arrival so that access may be granted.  

DELIVERY/ DELIVERABLES: Timely submission of repair essential to successfully completing this requirement. The contractor shall provide written documentation, as well as an emailed second copy, to the Government following the repair visit which details the service performed and certifies its completion.

Contract Type:  A Firm Fixed Price type order award not exceeding the Simplified Acquisition Threshold is anticipated to be awarded resulting from this requirement.
