Background/Description of Requirement

The law firm is being asked to: 1. Draft and file a PCT application based on the identified application below to include the new matter provided by the Inventor by the identified due date or any identified bar date. Designate the ISA as the EPO and designate all countries including the United States. Extensions of these times are to be approved in advanced. See provided Employee Invention Report (EIR) and accompanying materials. Provide document drafts only to LPM and the Inventor Point of Contact (2 below) unless instructed otherwise by the LPM. Application numbers based on eFiling receipts, postcards, or Official Filing Receipts must be reported within 6 weeks of filing. 2. Prepare a list of the application's claims and identify the inventors contributing to each independent claim through discussions with NIH inventor point of contact, individuals identified in EIR section 3, authors on manuscripts, publications, and/or other involved parties. 3. Obtain assignments from each inventor (encompassing the provisional application, any subsequent US or foreign applications, and the right to claim priority). SPECIAL ASSIGNMENT DOCUMENTS are required for SAICFrederick contract employees. 4. All PCT applications which claim the benefit of priority of one or more provisional applications need to be handled as follows. For all countries except the United States, the applicant should be The United States of America, as represented by the Secretary, Department of Health and Human Services (the Assignee). For the United States (US) only the applicant should be the named inventors NOT the assignee. Obtain powers of attorney from the inventors for the US non-provisional application. Soon after filing, take all steps necessary to change the applicant from the inventors to the assignee(s). 5. Reporting/Deliverable: Within 5 business days of the filing, the following should be sent to NIH via LFP: the reporting letter and all forms filed in the PTO as well as copies of the references cited in the IDS. For references other than U.S. Patents or other patent publications please include copies in PDF format.

Interested parties may identify in writing their interest and capability in response to this requirement. Responses to this notice shall contain sufficient information to establish the interested parties’ bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.

All responses must be received by closing date and must reference the announcement. Responses may be submitted electronically to the attention of the contract specialist. Fax responses will not be accepted.

All responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency.
